The husband had requested the re-examination of his wife based on recorded conversations on his mobile phone. The family court had allowed this application, prompting the woman to appeal to the High Court. Her lawyer argued that the family court’s decision infringed on her right to privacy, citing judgments from the Supreme Court and the High Court of Madhya Pradesh. The High Court, on October 5, ruled in favor of the woman, stating that the husband’s actions violated her right to privacy and the rights guaranteed under Article 21. The court emphasized that the right to privacy is an integral part of the right to life as stated in Article 21. The High Court set aside the family court’s order, stating that it had erred in allowing the application.
